This Privacy Policy (the “Policy”) explains how Minted, LLC ("Minted") handles your personal information we collect when you use our services over the Internet, including the Minted website located at www.minted.com and affiliated domains controlled by Minted (the “Website” and/or “Services”), and otherwise through our relationship with you.

Please review this Policy carefully. By using the Minted Website or any of the products or Services we provide, you agree to the personal information practices explained below, which may be updated from time to time. If you do not agree with these practices, please do not use the Website or Services or otherwise provide us with your personal information. Remember that your use of Minted’s Website and Services is at all times subject to the Terms of Service, which incorporate this Policy. Any terms we use in this Policy without defining them have the definitions given to them in the Terms of Service. If you have a disability, you may access this Privacy Policy in an alternative format by contacting privacy@minted.com.

REGISTRATION

We do not require registration in order to browse our Website. You may choose to give us your contact information during account creation or at other times. We then may use that information to contact you about the products and Services on our site. A Minted account is required to use certain interactive features such as reviewing products, saving designs, and placing orders. We also offer the ability to access Minted by logging in with or connecting via a third party social network or email service, including but not limited to Facebook or Facebook Connect (each, a “Third Party Platform”). If you access the Website via a Third Party Platform we will access and store the information explicitly allowed by the Third Party Platform under their terms of service or otherwise, once you allow us to do so, through an interface provided by the Third Party Platform. As we do not have control over the user interface provided by Third Party Platforms, we do not take any responsibility for any changes or problems with the interface or the exchange of information provided by any Third Party Platforms.

By accessing Minted via a Third Party Platform, you grant Minted permission to contact you at the email address associated with the Third Party Platform. Members of Minted’s marketing lists will occasionally receive information on our products, services, special sales, promotions and our newsletter. You may opt out from receiving this information, and you may unsubscribe at any time, by changing the settings in your account profile on the Website or by clicking the “unsubscribe” link in an email from us.

INFORMATION COLLECTED

The information described below includes the following categories of data within the meaning of the CCPA and CPRA (described under “California Privacy Rights”): Identifiers; Other individual records; Demographics; Commercial information; Internet activity; Sensory visual data; Geolocation data; and Inferences. We collect these types of information from our registered members, as well as people who use the Website without purchasing or registering for a membership, although we generally collect a more limited set of information from those who are not registered.

SOURCE OF INFORMATION: YOU

We collect personal information when you create an account with us and when you use our Services, and, in some circumstances, when you visit one of our physical store locations, if any.

Information you provide to us directly: We collect information you provide to us. For example, we collect personal identifiers such as your name and email address from you when you create a Minted account, so that you can log in to access your account. When you place an order, we collect your phone number, email address, billing and shipping address and credit card information (we retain only the last 4 digits, as your full credit card information is processed by a third party), so that we can fulfill your order and ship your product(s) or product sample(s). We may also collect information you provide as part of selecting your preferences, including within your account settings, the Minted products you have purchased or offered for sale. We also collect the information you provide for technical or customer service requests including via chat, email, text and phone. If you participate in user testing, we collect recordings of your user testing session. We collect your age, date of birth and professional/employment information only if you provide these to us voluntarily through your use of the Services.

A Minted account allows a user to utilize 'saved design' functionality on the Website. Users may customize a virtually unlimited number of stationery items. These saved designs, including their text, may contain personal information including names, photographs, addresses, contact information, dates of personal events and any other personal information you may provide. This information is only available to the registered user and Minted employees and contractors. The registered user also has the ability to 'share their saved designs.' This is available so that a customer can allow other people to view or comment on their saved stationery designs. Minted will provide a link to the invitee to view the saved stationery. Saved designs are not publicly available, but please note that anyone who receives the link to your saved design will be able to view it and access any personal information contained therein. A customer may also explicitly choose to share a design on a social network or other publishing mechanism. Any designs or personal information shared on third party services are subject to that service’s terms of use and applicable privacy policies.

Information Provided in Surveys, Promotions and Sweepstakes: Occasionally, you may take part in surveys, promotions, contests or sweepstakes sponsored by Minted. The information we collect from these surveys, promotions, contests and sweepstakes may be matched with individual customer accounts and used by Minted to improve your overall customer experience, and may be shared with the select third parties who we partner with in such surveys, promotions, contests or sweepstakes.

Information About Other People: We may collect and store information about other people that you provide to us when you use our services, including without limitation email and mailing addresses of family and friends (for example, when you submit an event guest list to create customized invitations, and when you provide any photographs of family and friends), and when you upload address, birthdate or occasion information in our our Minted Address collection. Any such information you store is personal information. We rely on you to obtain the permission of other people to allow us to collect their personal information. Please be mindful of your own privacy needs and those of others as you choose what to share and what to make public. We cannot control the privacy or security of personal information you choose to make public. We do not, however, “sell” or “share” information from your address book for advertising purposes within the meaning of the CCPA and CPRA (see “California Privacy Rights”).

Information Provided by Artists: If you participate in Minted as an artist, in addition to the above we may collect your name, Minted Artist Store name, signature, image, background and educational materials for purposes of offering and promoting your products on the Minted platform and applying your signature to manufactured products, and certain financial information for the purpose of paying commission or providing reimbursements to you. We may request that you agree to having your name displayed to visitors of the Website alongside your designs. Your product reviews, comments and any other information you make available in public areas of the Website can be seen by people and organizations not related to or controlled by Minted. If you participate in our user testing, we may collect recordings of your user testing session (with your consent). We may ask that you voluntarily provide demographic information such as birthday, race/ethnicity, gender identity, sexual orientation, and social handles in your artist profile, and to indicate whether you are comfortable being featured in marketing opportunities based on your reported identities.

Information we automatically collect when you use our Services:

We and our business partners may also automatically collect certain information about how you access or use our Website and our Services including, but not limited to, information about your internet domain address, clickstream information indicating your activities on our Website, IP address, browsing history and other electronic markers and identifiers. We also collect imprecise geolocation information as implied by your IP address. We collect inferences drawn from your activity and shopping preferences on our Website, including products or Services purchased, obtained or considered such as your purchase history or other purchasing or consuming histories or tendencies and, if you are a Minted Artist, your product and sales history. We collect these inferences so that we can better understand your preferences and behavior, including to customize content and display advertising to you.

We may also collect information through the use of cookies, pixels, web beacons and similar technologies. We use third-party service providers that may also use cookies, pixels, web beacons and similar technologies to help operate their services. For more information about use of cookies, please see our Cookie Policy. We also collect information when you interact with our customer service team and electronic customer service support, such as noting issues you raise and storing your conversations by phone or computer based chat sessions.

SOURCE OF INFORMATION: THIRD PARTIES

Social Networks and Third Party Platforms: By accessing Minted via a Third Party Platform, you authorize Minted to receive certain of your personal information that is available on or through your Third Party Platform account, including, without limitation, your profile information, name, email address, gender, birthday, current city, friends or follower names, your photos, profile picture, privacy settings and certain other information and identifiers that will be disclosed to you during the login process. The information we receive will depend on the policies and your account settings within the Third Party Platform.

Other Users: We also may receive certain personal information about you from other users when they upload your contact information to their address book, send you correspondence through Minted services including customer generated Minted Websites, include you in photographs or text in their submissions, or perform other Services-related activities.

Service Providers and Business Partners: We collect information from partners such as service providers (including data licensors, analytics providers, and payment processors), public databases, our marketing partners, and advertisers. This may include information about your interests, demographic data, purchasing behavior, and your activities online (such as websites visited and advertisements viewed). We use this to better understand your preferences and interests, and to customize content and advertisements for you.

CHILDREN’S PRIVACY

We do not knowingly collect or solicit personal information from anyone under the age of 18 (though adults may choose to provide information about those under 18, as described in “Source of Information - You; Information About Other People”). If you are under 18, please do not attempt to register for the Services or send any personal information about yourself to us. If we learn that we have collected personal information from a child under age 18, we will delete that information as quickly as possible. USE OF INFORMATION

OUR BUSINESS AND COMMERCIAL PURPOSES FOR COLLECTING PERSONAL INFORMATION

We process personal information to operate, improve, understand and personalize our Services. We use personal information for the following purposes:

Providing, Customizing, Supporting, Maintaining and Improving the Services:

  • Creating and managing your account or other user profiles
  • Providing you with the products, Services and information you request
  • Meeting or fulfilling the reason you provided the information to us
  • Providing and improving support and assistance for the Services
  • Allowing users to respond to and comment on customer generated Minted websites and other user generated content
  • Sending reminders and event invitations at the direction of users
  • Displaying guests’ names and comments by other guests of the same event
  • Sending post-event communication
  • Printing recipient addresses in your stationery or other orders
  • Improving the Services, including testing, research, analytics, and product development
  • Understanding how users interact with the Website and Services
  • Personalizing Website content and communications based on your preferences
  • Fraud protection, security, and debugging

Marketing the Services:

  • Providing a better website experience and gathering broad demographic information for aggregate use
  • Marketing and selling the Services
  • Showing you advertisements, including interest-based or online behavioral advertising

Corresponding With You:

  • Responding to correspondence received from you, contacting you when necessary or requested, including to update you regarding orders, order status and purchases made
  • Sending emails and other communications, including SMS text messages, that display content that we think will interest you and according to your preferences
  • Notifying you about certain products or Services we think you may be interested in learning more about

  • Fulfilling our legal obligations under applicable law, regulation, court order, subpoenas or other legal process, such as preventing, detecting and investigating security incidents and potentially illegal or prohibited activities

  • Responding to claims that any posting or other content violates third-party rights

INFORMATION SHARING AND DISCLOSURE

Minted will not rent, sell, or share your personal information with other people or non-affiliated companies except to provide products or Services that you have requested, as disclosed in this Policy, as you have otherwise agreed, or as set forth in the “California Privacy Rights” section. We do not sell your personal information for money. In certain circumstances, we may disclose your personal information to the following categories of service providers and other parties, in order for them to perform the following functions:

Service Providers:

  • Payment Processors
    • Our payment processing partners collect your voluntarily provided payment card information necessary to process your payment
    • If you sell products on Minted, our commission and reimbursement payment processors process your commission and reimbursement payments
  • Security and Fraud Prevention Consultants
    • Detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity
  • Hosting, Technology and Communications Providers; Fulfillment Providers; Manufacturing Partners; Product Rendering Software Providers; Data Storage Providers; User Testing Service Providers; Analytics Providers; Staff Augmentation Personnel; Trade Partners, i.e. photographers, wedding planners, venue coordinators, fundraisers and the like
    • To perform operational services (such as hosting, billing, fulfillment and shipping, data storage, security, web service analytics) and/or to make certain services, features or functionality available to our users
    • Debugging to identify and repair errors that impair existing intended functionality
    • Printing and online proof rendering services
    • Performing other services on our behalf, including maintaining or servicing accounts, providing customer service, assisting with customer designs, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing advertising or marketing services, providing analytics services, or providing similar services on behalf of the business or service provider we shared the information with
    • Undertaking research and user testing for technological development and demonstration of our Services
    • Undertaking activities to verify or maintain the quality or safety of our services
  • Ad Networks and Affiliate Marketing - we “share” (as defined in the CCPA and CPRA as described under “California Privacy Rights”) personal information with parties such as Facebook for these purposes
    • Ad customizing and serving
    • Auditing related to a current interaction and concurrent transactions, including, but not limited to, counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, obtaining “lookalike audiences” (which are leads to individuals with characteristics similar to those of our current customers), and auditing compliance with specifications and other standards
  • Marketing Cooperatives and Data Warehouse and Business Intelligence Services
    • Customization of products
    • Marketing products and services that are personalized to you
    • Obtaining lookalike audiences

Parties You Authorize, Access or Authenticate:

  • Other Users
    • Any information that you may share in a review posting or online discussion or forum is intentionally open to the public and is not in any way private. We recommend that you carefully consider whether to disclose any personal information in any public posting or forum. What you have written may be seen and/or collected by third parties and may be used by others in ways we are unable to control or predict
  • Other Individuals Directed by You
    • We will share your personal information with other individuals as directed by you, for example if you use Minted to send products to another individual
    • You may specify an email address for the recipient if you wish for us to send them an email notification 'gift message.' The shipping recipient will not be opted in to any marketing distribution lists without their explicit permission
    • We may disclose your information to users and guests invited by you to use services that you have requested, including without limitation customer generated Minted Websites. You may also choose to share your personal information publicly in connection with our services, including Wedding Websites, if provided
  • Social Media Services
    • We will share your personal information if you intentionally interact with any social media service through the Services, to the extent authorized by you and/or the terms of the social media services
  • Third-Party Business Partners You Access Through the Services
    • To meet or fulfill the reason you provided the information to us

Legal and Investigation Matters: We may disclose personal information in order to respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims. We also may share personal information when we believe it necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Service, or as otherwise required by law.

Business Transfers: Furthermore, if we choose to buy or sell assets, user information is typically one of the transferred business assets. If we, or substantially all of our assets, were acquired, or if we were to go out of business or enter bankruptcy, user information would be one of the assets that is transferred or acquired by a third party, and we would share personal information with the party that is acquiring us or our assets. You acknowledge that such transfers may occur, and that any acquirer of us or our assets may continue to use your personal information as set forth in this policy.

Access and Deletion

You may edit your Minted account information at any time. You can opt in or out from future communications of special offers and new product information, or you can unsubscribe by following instructions contained in the messages you receive or by contacting privacy@minted.com. We may send you certain communications relating to our service, such as service announcements and administrative messages that are considered part of your account membership. We do not permit you to opt-out of receiving those messages.

You may request closure of your account by contacting us at privacy@minted.com. If you do this, we may retain the personal information in your account in our systems, even if your account is inactive. To request permanent deletion of your Personal Information, please follow the process for deletion described under “California Privacy Rights,” “Colorado, Nevada, Utah, Virginia, Connecticut and Utah Resident Rights” or “EU Residents” below.

CALIFORNIA PRIVACY RIGHTS

The California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA) provide California residents with additional rights as described below. As a matter of company policy we extend the California rights, which we believe to be most protective of consumers, to all US customers, although we honor requests under the Colorado, Nevada, Virginia, Connecticut and Utah laws as well. We will continue to honor requests under other applicable state and other laws as they are adopted after the date of this Policy. For this section, we use the terms “personal information,” “share” and “sale” as those are defined in the CCPA and CPRA.

Disclosures of Your Personal Information

Notice of Collection: We collect (and have collected over the past 12 months) the categories of personal information from or about our customers (including in some circumstances when you shop at a Minted retail store, if any) described under “Information Collected,” and may disclose this information for a business purpose. To learn more about the business or commercial purposes for collecting this information, see “Our Business and Commercial Purposes for Collecting Personal Information.” To learn how we use this information, see “Use of Information.” For a description of the categories of third parties with whom we have shared personal information for a business purpose, see “Information and Disclosure.”

Your Rights Under the CCPA and CPRA

Access: You have the right to request certain information about our collection and use of your personal information over the past 12 months. In response, we will provide you with the following information, as requested by you:

  • The categories of personal information that we have collected about you
  • The categories of sources from which that personal information was collected
  • The business or commercial purpose for collecting, sharing or selling your personal information
  • The categories of third parties with whom we have shared or to whom we have sold your personal information
  • The specific pieces of personal information that we have collected about you
  • If we have shared or sold your personal information to any third parties for a business purpose over the past 12 months, the categories of personal information shared with each category of third party recipient

Deletion: You have the right to request that we delete the personal information that we have collected about you. Under the CCPA and CPRA, this right is subject to certain exceptions: for example, we may need to retain your personal information as required by law or we may need to retain your data to provide you with the Services or complete a transaction or other action you have requested. If your deletion request is subject to one of these exceptions, we may deny your deletion request. If we are not able to comply with your request for data deletion, we will let you know we are unable to comply and the reason why.

Correction: You have the right to request that we correct inaccurate personal information that we maintain about you. We will take into account the nature of the personal information and the purposes for which we process it. We may require documentation from you in order to process your request, including your name, email address, phone number, and request details.

Opt-Out of Personal Information Sale or Sharing: While we do not share your personal information in exchange for money, we may disclose certain information about you if you are a Minted customer for purposes that may be considered “sharing” or a “sale” under the CCPA and CRPA. The business or commercial purposes of sharing or “selling” personal information is for third-party companies to perform services on our behalf, such as marketing, advertising, and audience measurement. For the purposes of the CCPA, over the last 12 months, we have shared or “sold” or “shared” the following categories of personal information to third parties:

  • Personal identifiers/contact information
  • Customer records identified by state law
  • Commercial information
  • Internet or other similar network activity information
  • Geolocation data
  • Inferences drawn from other personal information and the above

We may “share” or “sell” your personal information to the following categories of third parties:

  • Advertisers and advertising networks
  • Data warehouse partners
  • Marketing Cooperatives
  • Data Analytics Platforms and Providers
  • Social Networks

Once you have submitted an sharing and sale opt-out request, as described above, we will not ask you to reauthorize the sharing or sale of your personal information for at least 12 months. We do not knowingly share or sell the personal information of minors under 18 years of age.

Exercising Your Rights: To exercise the rights described above, you must send us a request that (1) provides sufficient information to allow us to verify that you are the person about whom we have collected personal information, and (2) describes your request in sufficient detail to allow us to understand, evaluate and respond to it. Each request that meets both of these criteria will be considered a “Valid Request.” We may not be able to honor requests that do not meet these criteria. We will only use personal information provided in a Valid Request to verify your identity and complete your request. You do not need an account to submit a Valid Request.

We will work to respond to your Valid Request within 45 days of receipt, though this time period may be extended under the CCPA and CPRA if we need more time to complete your request. We will not charge you a fee for making a Valid Request unless your Valid Request(s) is excessive, repetitive or manifestly unfounded. If we determine that your Valid Request warrants a fee, we will notify you of the fee and explain that decision before completing your request.You may submit a Valid Request using the following methods:

You may also authorize an agent (an “Authorized Agent”) to exercise your rights on your behalf. To do this, you must provide your Authorized Agent with written permission to exercise your rights on your behalf, and we may request a copy of this written permission from your Authorized Agent when they make a request on your behalf.

We Will Not Discriminate Against You for Exercising Your Rights Under the CCPA and CPRA: We will not discriminate against you for exercising your rights under the CCPA and CPRA. We will not deny you our goods or services, charge you different prices or rates, or provide you a lower quality of goods and services if you exercise your rights under the CCPA and CPRA. However, we may offer different tiers of our Services as allowed by applicable data privacy laws (including the CCPA and CPRA) with varying prices, rates or levels of quality of the goods or services you receive related to the value of personal information that we receive from you. In addition, for technical reasons, your account will not function if we delete all of your personal information.

Retention of Personal Information

We retain personal information we collect from you where we have an ongoing legitimate business need to do so (for example, for one year after your account becomes inactive, as needed to provide you Services you have requested, or to comply with applicable legal, tax or accounting requirements). This may also include situations where litigation is pending or ongoing and such information is subject to a legal hold. When we have no ongoing legitimate business need to process your Personal Data, we will either delete or anonymise it or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible. Where we rely on your consent, you have the right to withdraw it at any time in the manner indicated when you consent. After you have requested that your account be closed, we will retain the personal information for one year upon which it will be deleted. Sensitive Personal Information

At this time we do not collect “Sensitive Personal Information” as defined by the CPRA, except to the extent that Minted artists provide demographic Sensitive Personal Information voluntarily. Minted uses this information for internal purposes only unless specifically authorized by the Minted artist. You can opt out of these uses by:

Other California Resident Rights: California’s “Shine the Light” law (Cal. Civ Code § 1798.83) permits California residents to request and receive, once per calendar year and free of charge, information about our sharing of your personal information (if any) with third parties for their own direct marketing use. COLORADO, NEVADA, UTAH, VIRGINIA CONNECTICUT AND UTAH RESIDENT RIGHTS

If you are a resident of Colorado, Nevada, Virginia, Connecticut or Utah, or of another state that adopts an online privacy statute after the date of this policy, you may have rights similar to those of California residents as described above. USERS FROM OUTSIDE THE USA

Your personal information will be collected and stored in the United States, and subject to the laws of the United States. If you reside in a country outside the United States, please note that the data protection and privacy laws of the United States may not be as protective as the laws in your country. You agree that except to the extent laws of another jurisdiction are directly applicable to Minted, the laws of the United States and the State of California will govern the processing of your personal information, including any obligations of security and third party sharing.

EU Residents

If you are a resident of the European Union (“EU”), United Kingdom, Liechtenstein, Norway, or Iceland, you may have additional rights under the EU General Data Protection Regulation (the “GDPR”) with respect to your Personal Data.

For this section, we use the terms “Personal Data” and “processing” as they are defined in the GDPR. Minted will be the controller of your Personal Data processed in connection with the Services.

If there are any conflicts between this section and any other provision of this Policy, the policy or portion that is more protective of Personal Data shall control to the extent of such conflict. LAWFUL BASES FOR PROCESSING PERSONAL DATA

We will only process your Personal Data if we have a lawful basis for doing so. Lawful bases for processing include contractual necessity and our “legitimate interests” or the legitimate interest of others, as further described below.

  • Contractual Necessity: We process the following categories of Personal Data as a matter of “contractual necessity”, meaning that we need to process the data to provide you with the Services, for example to create your account, complete your order, ship your product, and provide customer support.
